The August meeting of the Upper Frederick Township Planning Commission was called to order by the Chairman at 7:00 PM. Attending were Robert Young, Chairman; William O'Donnell, Planning Commission Member; Randy Wampole, Planning Commission Member; Julie Spahn, Planning Commission Member; Norm Ulrich, Township Engineer; Kenn Picardi, Township Solicitor; Tracy Tackett, Township Planner; Jackie Tallon, Township Manager; and Sherry Zawada, Administrative Assistant.

Approval of Minutes

Mr. Wampole made a motion to approve the Minutes from the July 30, 2009 Planning Commission meeting. Mr. O'Donnell seconded the motion and it passed unanimously.

Other Business

Riparian Corridor Conservation Ordinance

Ms. Tackett commented on a Montgomery County Planning Commission review letter concerning the Riparian Corridor Conservation Ordinance. A discussion took place regarding this review letter and the details of the Riparian Corridor Conservation Ordinance. The Planning Commission directed Ms. Tackett to make a few minor changes which were discussed and to move forward in the adoption of the Riparian Corridor Conservation Ordinance. The changes were as follows:

1. Steep Slopes - The County suggested using a 25% designation instead of 15%, so as not to negatively impact agricultural uses. The Planning Commission designated using the 15% standard, since 15% is the standard used throughout the Township Ordinances. The Planning Commission stated that the agricultural uses that are already within this buffer area may continue because they existed prior to the adoption of this Ordinance.

2. Conditional Uses - The County expressed concern regarding the potential excessive amount of conditional uses that may be triggered. The Planning Commission agreed that, if necessary, amending the Ordinance to make conditional uses permitted uses can be done at a later date.

3. Corridor Crossings - The County suggests including a standard that an applicant must demonstrate that no other crossing alternative is available. Tracy Tackett, Township Planner, stated that this change would be beneficial, particularly if corridor crossings become permitted by-right. Ms. Tackett suggested adding a clear connection to the previous section, mitigation measures. The Planning Commission stated that this change could be made at a later date.

4. Swimming Pools - The County recommends that if swimming pools are permitted as an accessory use that they be prohibited. Norm Ulrich, Township Engineer, commented that a pool should be allowed as long as a lawn is permitted for that property.

5. Outlet Installation - The County notes that the language for outlet installation is unclear. Ms. Tackett stated that if outlet installations are prohibited in the Zoning Ordinance the Township Engineer should not be able to approve them. Rather, if there are times when outlet structures may be appropriate, then the Township should permit them by conditional use, subject to conditions recommended by the Township Engineer. The Planning Commission decided to prohibit outlet installation in Zone 1.

6. Stormwater Basins - The County recommends the Township Engineer comment on this provision. Norm Ulrich, Township Engineer, stated that this provision should not be changed.

7. Hazardous and Noxious Materials - The County recommends referencing the list of hazardous and noxious materials in the floodplain chapter. The Planning Commission directed Tracy Tackett, Township Planner, to reference these materials.

8. RCC Map - The County questioned whether this map has been developed. Ms. Tackett commented that the map has been developed and that a copy of the map should be sent to the County.

Mr. Young made a motion to authorize the changes to the Riparian Corridor Conservation Ordinance and to recommend approval to the Board of Supervisors as contingent upon the changes referenced by Tracy Tackett, Township Planner, Norm Ulrich, Township Engineer, and Ken Picardi, Township Planning Commission Solicitor. Mr. O'Donnell seconded the motion and it passed unanimously.

Proposed Zoning Changes

Ms. Tallon stated that the proposed zoning changes are being reviewed by David Allebach, Township Solicitor, and Norm Ulrich, Township Engineer.

Ms. Tackett stated that the August Regional Planning Commission meeting was cancelled.

Adjournment

Mr. Wampole made a motion to adjourn the meeting at 7:35 PM. Mr. O'Donnell seconded and the meeting was adjourned.
